You agree that your products do not infringe or defame third parties, including copyright, trademark, publicity, or privacy rights, and that your products do not contain third-party materials. You are solely responsible for using the content in combination with other images, graphics, text, or other materials that you incorporate into the product. You agree not to include any third-party text, images, designs, trademarks, service marks, or copyrighted materials in your Products unless you have proper permission from the owner. We warrant that we have all necessary rights or permissions for your product. By placing an order on this site, you warrant that you have all necessary permissions, rights and authority to place an order and authorize The Custom Bakery Boxes to manufacture products on your behalf.

CONTENT

You are solely responsible for using content in combination with any other images, graphics, text, or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, the right of publicity or privacy, and will not libel or defame any third party and that you have all required rights or permissions necessary to incorporate third party material into your Products. By placing an order on this Site, you warrant that you have all necessary permission, right, and authority to place the order and you authorize The Custom Bakery Boxes to produce the Products on your behalf.

All information, data, text, photographs, graphics, messages, and any other materials (“Content”) are the sole responsibility of the person that produced such content. Accordingly, you are responsible for all content that you transmit, upload, post or otherwise transmit through the Website. You agree to comply with all local rules regarding online conduct and acceptable content. You agree not to use the Website to upload, post or transmit content that is obscene, illegal, or infringes the intellectual property or other proprietary rights of The Custom Bakery Boxes or any third party.

The Custom Bakery Boxes does not control the content posted by s and does not guarantee the accuracy, completeness, or quality of the content. When you, or someone to whom you have given access, orders a print item using your password, you grant The Custom Bakery Boxes the worldwide, royalty-free, and non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display, and create derivative works from the content on the website and on the printed product to store designs or processing print orders.

You acknowledge that The Custom Bakery Boxes and its designees shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. DESIGN FILES

The Custom Bakery Boxes only offers 72 DPI (low resolution) design files. Please contact our customer support if you would like to purchase high resolution design files.

SUBMITTED ARTWORK

All graphics, designs, and images must be provided in CMYK format and at a resolution of 300 DPI or higher. The Custom Bakery Boxes is not responsible for any color changes that occur when converting from RGB to CMYK color mode. The Custom Bakery Boxes is also not responsible for any blurry, distorted, or pixelated images printed due to client-submitted artwork.

PROOFING & MATCHING

All print jobs require customer approval for final artwork and job specifications. Once an order is confirmed, an artwork proof and order specification will be emailed to the client. The client is responsible for verifying all details provided in the data sheet (including but not limited to delivery dates and/or production speeds) to ensure that all customer requirements are accurately described. I have. The Custom Bakery Boxes cannot be held responsible for specifications and requirements beyond those stated in the Final Specifications. Furthermore, proofreading is the client’s responsibility, so it is the client’s responsibility to check the proof of the final artwork. Files are prepared in a variety of ways, which can lead to unexpected changes. What is shown on the final proof is representative of what will be printed. The Custom Bakery Boxes strongly recommends printing proofs at 100% to see actual placement, spelling, and other design elements. The Custom Bakery Boxes is not responsible for design or spelling issues not identified by the client and promptly reported to The Custom Bakery Boxes. Once approved, the design files and job specs are sent to manufacturing for immediate printing.

The Custom Bakery Boxes is not responsible for color matching or ink densities of client approved screen proofs. Screen proofing predicts design layout, text accuracy, image aspect ratio, and placement but not color or density. The Custom Bakery Boxes attempts to match the gradient density of each duo tone color. The Custom Bakery Boxes is not responsible for the final appearance of duo tones unless the client orders a color proof. Also, lamination can affect or change the appearance of printed colors. The Custom Bakery Boxes is not responsible for the final color appearance of laminated products.

MATERIALS

Please note that the paper/cardboard used to print our products is not food safe. If you have any special food-grade requirements for the paper, please let us know before placing your order. Any such need must be communicated immediately in writing.

Client is responsible for approving proofs and layouts prior to printing. The Custom Bakery Boxes is not responsible for defects in printed products resulting from:

Placing or aligning graphics and using inappropriate fonts
Spelling, Grammar and Punctuation Errors
Improper die-cutting, slitting, or false crease missing
Finished product size

COLOR ACCURACY AND HARD COPY PROOF

The Custom Bakery Boxes will reproduce the colors of the submitted printable files as accurately as possible. However, The Custom Bakery Boxes cannot guarantee color match and color density due to printing process limitations, different characteristics of different printing surfaces, and adjacent image ink requirements. Color reproduction is guaranteed to be accurate within 90% of the final customer approved proof. Please note that The Custom Bakery Boxes cannot guarantee color reproduction of ready-to-print files unless a hardcopy proof is ordered for an additional fee. Please note that The Custom Bakery Boxes is not responsible for any color differences between the printable images submitted and the actual artwork or products they represent.

INDEMNITY

You will indemnify The Custom Bakery Boxes and the parties to whom thecustombakeryboxes.com™ has licensed portions of its content and their directors, officers, and employees from all claims, liabilities, damages, costs, and expenses.

You agree to defend. (i) your violation of these Terms & Conditions; or (ii) text, photographs, images, graphics, or other materials incorporated into the Products that were not part of the standard Site Content.

ORDER CANCELLATION

The Custom Bakery Boxes cancels orders prior to printing/shipping. However, we cannot accept cancellations after your order has been shipped. Cancellation during production is possible, but a cancellation fee will be charged. Our customer service team will inform you about the cancellation fee.

All orders can be canceled before Stage 2. If the order is canceled in stage 1. $15 plus 5% of the total amount will be charged to cover payment processing, bank charges, and design department fees. For orders canceled in Stage 2, a minimum of 20% of the total order amount will be deducted as a cancellation fee to cover the costs of the design department. You can still try to cancel an order after it has entered Phase 3, but we cannot guarantee that it will be canceled. However, if the order is still in Phase 3 and the user wants to cancel the order. At least 50% of the total order amount will be deducted to cover costs. Once an order reaches level 4, it can no longer be canceled.

REPRINTS

The client must notify The Custom Bakery Boxes within 3 business days of delivery of the order if Customer discovers any defects, damage, or missing parts in the products delivered. The Custom Bakery Boxes is not responsible for any defect, damage, or missing item claims not submitted within 3 business days from the date of delivery.

To obtain a replacement, the client must return (at his own expense) at least 99% of the products he received within 10 days of the original order’s delivery date. No returns will be accepted without a prior written return authorization from The Custom Bakery Boxes.

All charges associated with expedited printing (rush printing or shipping) are non-refundable, including orders that are returned for any reason. No exceptions.

SHIPPING AND DELIVERY OF ORDERS

The Custom Bakery Boxes offers the following product options when ordering:

PRIORITY – GUARANTEED TO SHIP WITHIN 8 BUSINESS DAYS:

Products will be shipped within 8 business days after final calibration approval

EXPRESS SHIPPING – GUARANTEED TO SHIP WITHIN 6 BUSINESS DAYS

Free ground shipping within the 48 contiguous states.
Products will be shipped within 6 business days after final calibration approval

In all cases, final approval of evidence must be received by 11:00 am. Otherwise, one business day will be added to the delivery time.

The Custom Bakery Boxes will always act to print and ship orders in a timely manner. In no event shall The Custom Bakery Boxes be liable for any consequences or damages resulting from delays in the manufacture, shipment, or delivery of ordered products.

All The Custom Bakery Boxes clients agree that The Custom Bakery Boxes may be liable for any damages resulting from technical problems, weather conditions, carrier delays, international customs issues, or other circumstances beyond the direct control of The Custom Bakery Boxes. You agree that we are not responsible for any delays in shipments. The Custom Bakery Boxes shipping and delivery dates are calculated based on supplier quotes and recent order history.

The Custom Bakery Boxes will always act to ensure that delivery times are met. However, unexpected device failures, malfunctions, or technical problems may delay the printing or shipping process. In the event of delays in the printing or shipping process, expedited or expedited charges will be refunded or waived as appropriate. We cannot accept cancellations due to delays in printing or shipping. All The Custom Bakery Boxes clients agree to pay all duties and fees for goods shipped to their respective locations. Customs clearance for shipments shipped outside the United States and Canada is the responsibility of the customer.

Our production houses are working in almost every part of the world, but Asia is the most important part of all, especially South Asia where quality and competitive price is always available, and you do not need to be worried about shipping as it is our duty to provide you the product on your doorstep with no extra charges! DAMAGED AND LOST PACKAGES

Clients are responsible for inspecting all packages for any visible signs of damage or missing items (when compared to the items listed on the enclosed packaging slips or invoices) before accepting delivery. In case of damage or missing items, the clients should immediately notify The Custom Bakery Boxes and the delivery courier. The Custom Bakery Boxes is not responsible for any damage or missing item claims not submitted by the customer within 3 business days of delivery of the order. The Custom Bakery Boxes is not responsible for third-party shipping errors, omissions, or damaged shipments.

Each product ordered usually comes with a few extra pieces free of charge. Infrequently ordered shipments may have slightly fewer parts than ordered. Printing industry standards allow up to 5% underrun or overrun. Therefore, if you need an exact quantity, we recommend ordering 10% more than your required quantity.

Additional shipping and handling fees will be charged for packages that must be reshipped due to the client’s mistake in providing the correct shipping address.

DISCLAIMER OF WARRANTIES

The website and its content are provided “as is” and without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. You acknowledge that the operation of the website may be uninterrupted or error-free. References and links to products or services of independent companies may appear on the website. These references and links are provided “as is” without warranty of any kind, either express or implied.

LIMITATION OF LIABILITY

The Custom Bakery Boxes or its licensors, suppliers or vendors, and their officers, directors, employees, or agents will not be liable for any special, incidental, indirect, or consequential damages of any kind or any damages resulting from loss of use. We are not responsible for damages resulting from errors, omissions, viruses, delays or interruptions in service. In no event shall The Custom Bakery Boxes be liable for any damages or consequences arising from or related to the improper or unauthorized use of this website or its contents.
